12.1 (4) of transfer guideline of KVS.
Sir, Desperately am waiting for truthful justice till today.Though the minor penalty was for one year; the transfer based on that is for ever. since 3 years am away from family for no fault of mine.
I ; Vighneshwar Bhat TGT Sanskrit,KV No 1, Jalahalli Bangalore was
transferred to KV Bijapur under para 8(iv) of transfer guidelines on Public
Interest in July 2009.Transfer was done on the basis of false charges like
five minutes , eight minutes late going to classes(of course these were
free periods) and for carrying on the wood works for house construction;
further imposition of minor penalty of withholding an increment with out
cumulative effect (all this without any enquiry); just because I objected
the Principal misusing quarters repair funds. Though my Grievance
submission dt 30.01.09 and Appeal dt 04.07.09 was pending I was abruptly
transferred on 08.07.2009. Afterwards the Appeal was disposed on 17.08.2009
upholding the decision.
Unfortunately my Review submission dt 11.09.2009 & 05.11.2009 is
disposed vide* F.13063/12(AP)2010-kvs(vig) on 27.07.2010 *by Hon’ble DC
(admn) without considering the true facts ; upholding previous decision of
penalty and punishment transfer.Sir; now the matter is in *CAT, Bangalore ;
case no O A 352/2010.In its order No. OA /120/2010 Dated 30.03.2010 it
was stated that this transfer was an arbitrary action* when the Appeal
disposal was pending and The KVS was directed to give justful order while
disposing the long pending Review submission. The vacancy in kv Jalahalli
is kept vacant till court decision.
Problem- 1. the teacher is under depression due to humiliation, harassment
and staying away from family (since 3 years); health badly
affected.
2. Family life is disturbed; mother asthama patient requiring regular
treatment.
3. Spouse working as Lecturer in state aided college in Bangalore and only
single girl child studying sixth std is not able to get my care and love
as I can’t shift family to Bijapur.
4. Sanskrit students are suffering without proper teacher for board classes
in KV No1, Jalahalli.A contractual teacher is appointmented.
5. Built the house in Bangalore city out skirts raising bank loan but not
able to occupy the same without final touchs; kept it locked.Thus it caused
financial losses.
Solution: Clear vacancy exists only in KV no1, jalahalli from where was
transferred .Another teacher Sri N M Bhat TGT Sanskrit KV MEG& Centre,
Bangalore has applied for local transfer to Jalahalli.A new KV is started
in K R Puram, Bangalore.Thus I may kindly be accommodated in any of these
KVs in Bangalore.
I hereby submit to your kind self with the following facts for your
kind perusal to provide me justice.
I was issued a warning letter dt 28.01.2009 by The Principal KV no1,
Jalahalli Bangalore. With out recording any observation on me afterwards I
was falsely charge sheeted on 20.04.2009 (nearly after a lapse of 80 days);
for five minutes, eight minutes late going to the classes and carpentry
work done in my staff qtrs premises for own house construction. Once a
minor penalty of withholding an increment was imposed on me; I submitted an
Appeal dt 04.07.2009. Abruptly I was transferred to KV Bijapur on
08.07.2009 even before disposal of my Appeal. Appeal was disposed on
17.08.2009 and the penalty imposed on me was upheld. Thus digging the same
old matter I was repeatedly harassed and punished through warning letter,
charge sheet, imposition of penalty finally transfer based on that. These
facts clearly indicate the intentional harassment caused to me.
My Grievance submission to The Principal through The Grievance Cell KV no1
Jalahalli dt 30.01.2009 is still pending redressal; in which the misuse of
staff quarters repair funds by *Shri.C Mani*, (presently A C in Silchar R
O)The Principal KV no 1 jalahalli, Bangalore is reported which is the root
cause of all the crises. Though all the occupants of staff qtrs submitted
requisition for required annual repairs; neglecting all this even like
white wash/cem,the major part of the funds were utilized for the renovation
of The Principals qtrs without the approval of repair committee. As a
member of the repair committee I objected to this. So I have been targeted
and punished like this. The derogatory remarks about KVS made by The
Principal was also reported in my grievance letter.(he wanted to make good
the losses as he went to Supreme Court to retain The Principals post; being
the promotee Principal) further continuous harassment caused to me was
explained in my reply submission dt 02.05.2009.
Due to my transfer our family is put to a great hardship. My mother is a
chronic patient requiring regular treatment. My wife is serving as a
Lecturer in state Govt aided college (non transferable) in Bangalore . My
single girl child studying in seventh std is not able to get my care and
love.
I have been always producing excellent results in all the classes I taught;
four- five students scoring 100% marks every year in CBSE class X results;
many more scoring above 90% marks without any failure. I have received
Certificate of Excellence from KVS Head Quarters for producing good
results. Being Post Gratuate in two subjects I also taught English and
Economics in in kv; apart from my teaching experience of Economics in
college and Military School in Bangalore before joining KVS in 1993.
